4) Condolences/In Memoriam/Wreath Funds Alan Hardy Just wanted to let everyone know that our darling Alan died very suddenly of a massive heart attack on Albany Golf Course on Friday 11th March. We as the family are devastated but know this is what Alan would have wanted. He lead an amazingly exciting life and was so talented in so many ways, but oh we shall miss him. 7) Bulawayo News Hello Mags This is to answer questions frequently raised by the motoring public, which your Morning Mirror readers should find useful. The update deals with SI 129/2015 - ROAD TRAFFIC (CONSTRUCTION, EQUIPMENT AND USE) REGULATIONS, implemented on 14 December, 2015. Future updates will cover the other issues most frequently encountered, including amber lights, driver's licences, etc. We start with an apology to the many motorists who have not received a reply to traffic related queries. Big Sky has been overwhelmed by the amount of correspondence and is putting in place the resources to enable prompt replies, and you will be contacted in the near future. Space-saver spare wheels (and run-flat tyres): The issue of space-saver spare wheels is currently the most abused section of Statutory Instrument 129/2015. Sect. 53 (1) (a) states the spare wheel must be serviceable, in the same way a fire extinguisher must be serviceable. If your spare wheel is inflated, has sufficient tread and is suitable for use, ZRP should accept it. However ZRP is applying Sect. 14 (6) (a) No person shall drive on any road a vehicle if - (a) any tyres on any one axle of the vehicle are of a different size or type or construction. Which would be the case if the space-saver tyre was being USED in the event of an emergency. In practice, while the space-saver is stored in its compartment, the motorist is complying with both Sect. 14 and Sect. 53. ZRP's stated objective is to reduce road carnage. Enforcing the use of full size spare wheels in vehicles that are not designed to accommodate them is counter-productive. Unsecured spare wheels become missiles in the event of an accident. Ditto for modern vehicles with "run-flat' tyres that have no accommodation for spare wheels. What should happen: ZRP Traffic HQ should urgently instruct personnel at every check point across the country to stop penalising motorists for carrying a piece of equipment that is accepted across the world for use in emergencies, and is forcing motorists to carry unsecured and highly dangerous alternatives. Of relevance is the exact requirements for Tyres appeared in SI 154/2010, (implemented in 2011); and appear UNCHANGED in SI 129/2015. THE SPACE SAVER SPARE WHEEL HAS BEEN ACCEPTED SINCE 2011. IT SHOULD BE NOW ... In the absence of positive intervention by Traffic HQ, we should expect: 1. The motor vehicle industry to engage the Ministry of Transport to make provision for space-savers and run-flats. They're here to stay and the statutory gazette will have to be amended. 2. The Traffic Safety Council of Zimbabwe to intervene in the interest of preventing deaths as a result of unsecured spare wheels being carried in passenger compartments. Breakdown triangles (described in Sect. 52 as a 'Special visual warning device'): The specifications for this simple piece of emergency equipment run over two pages of SI 129/2015, with a detailed diagram appearing on a third page. Based on the feedback from motorists' experiences at police check points, the main points being checked are: - To be reflective both sides - Length of sides 42,5 cm - Manufacturers name, year of manufacture and serial number - Two triangles to be carried per vehicle, and two per trailer Please note: - Despite all the detail, SI 129/2015 does not mention the triangle should be RED. - No differentiation is made between light and heavy vehicles. All vehicles require the same unit. The triangle as described does not exist in Zimbabwe and possibly the world. However there are a substantial number of breakdown triangles owned by motorists that suit their intended function. Motorists are purchasing new equipment to avoid fines of up to $20.00; with both the purchases and regular fines adding to economic hardship. What should happen ZRP Traffic HQ should urgently instruct personnel at every check point across the country to accept a motorists' breakdown triangle if it meets its intended purpose. If this appears impractical: The exact requirements for Triangles appeared in SI 154/2010, (implemented in 2011); and appear UNCHANGED in SI 129/2015. A BREAKDOWN TRIANGLE THAT SUITS ITS INTENDED PURPOSE HAS BEEN ACCEPTED SINCE 2011. IT SHOULD BE NOW The Standards Association of Zimbabwe should be mandated to draft a national standard for advance warning triangles. This process was started in October, 2010 (Technical Committee ME25: Motor Vehicle Inspection, refers). We're not aware of any outcome. First prize for the country will be acceptance of a triangle that is capable of being manufactured in Zimbabwe, creating job opportunities. Visitors to Zimbabwe: Sect. 53 of SI 129/2015 covers the spare wheel, tools (jack and wheel spanner) and the fire extinguisher. Sect. 53 (3) states 'This section shall NOT APPLY to motor vehicles bearing foreign registration number plates that are in transit or on a temporary entry permit'. Visitors are exempt from the requirement for Commercial vehicles to be fitted with a red retro reflector (reflective strip), under Sect. 38 (2) (d). (See www.bigsky.co.zw/cubbyhole-notes for the definition of a commercial vehicle). (These exemptions were noted by ZRP representatives attending the ZTA-Industry Stakeholders Interface in Harare on 11th September, 2012). Driving with headlamps and fog lamps on simultaneously was a specific offence under Sect 18 (3) of the 1972 regulations BUT ONLY AT NIGHT. However the requirement is not part of Sect. 19 of SI 129/2015. Many countries, South Africa included, encourage the use of day-time lights to improve visibility and therefore safety. However a visitor travelling the Beitbridge road will probably be fined for being safety conscious before he reaches Masvingo. Personnel at ZRP check points do not appear to be familiar with the sections of SI 129/2015 that provide for exclusions for visitors. This is based on feedback from visitors who have had expensive and holiday-spoiling experiences on the Chirundu - Harare, Beitbridge - Harare and Bulawayo - Harare roads. The outcome of the negative experiences is to reduce domestic tourism (as noted by a reputable hotelier, it is NOT a pleasure to self-drive around our country at present). And every regional visitor who has experienced unreasonable and costly treatment at police checks, returns home vowing never to return to Zimbabwe, and tells all their friends. This is terribly unfortunate, given the considerable and commendable efforts by the Ministry of Tourism, the Zimbabwe Tourism Authority and Zimbabwe Council for Tourism. The many achievements of these bodies are being rapidly undermined by the sheer number of roadside check points, and unfair treatment at them. What should happen ZRP Traffic HQ should ensure personnel at the check points on all main access roads into Zimbabwe are familiar with the exemptions applying to visitors, and the impact police behaviour has on our greatly needed tourism. General - vehicle construction, equipment and use: Dashboard camera's (dashcams) are legal. Motorists travelling on their own, particularly women, should be aware of a scam involving brake lights. If on your own and asked to test your brake lights, you'll need some help to witness whether they are working or not. These new rules are going to impact all accounting and audit firms considerably, as well as taxpayers who prepare their own returns. Public Notice 8 of 2016 states: All taxpayers are specified taxpayers and required to complete self assessment forms ITF12c on line. This return is due by the 30 April, 2016. The only exceptions are taxpayers in full time employment who do not receive any other income. There are no more ITF12 or ITF1A forms. In the past the Commissioner- General refused to entertain extensions for self assessments taxpayers. Mr. Manuel Lopes is currently lobbying for a blanket extension to be given with regards to the date that ITF 12 C's must be filed, but with the $30 per day penalty looming over all taxpayers in respect of late filing we recommend that you act as quickly as possible, and also lobby for an extension of time if applicable. Public Notice 9 of 2016 states: All taxpayers must register on line by the 1 April, 2016 so that you can access the e-services platform. The following returns can only be lodged online: Income Tax Returns Value Added Tax Forms PAYE advice forms P.2 Capital Gains Tax Returns Rev5 forms Presumptive Tax Returns. After the 1 April 2016 Zimra will not process tax returns which are submitted manually. DORMANT COMPANIES. The provisions of the proviso to section 37 of the Income Tax Act states that a written sworn statement must be made to the effect that no business or trade was conducted during the tax year ended 31 December , 2015. It must be signed by a Public Officer, or a director or the holder of a majority or plurality of its shares and it must be submitted to the Commissioner- General within 30 days of the date of the Public Notice. ... Unfortunately there is no date on the Public Notice but we have calculated the thirty days to expire on the 25 March, 2016. Failure to furnish this statement in respect of dormant companies makes you liable to more penalties. WARNING. Section 42 of the Income Tax Act states that every company shall file with the Commissioner a copy of the memorandum and articles of association within 30 days of its incorporation or registration under any law. If you fail to fulfill this duty you are liable to another fine and or prison.
