7) Bulawayo News The recent announcement of an increase in Deposit Fines, and the gazetting of SI 129/2015, is of interest to your readers ... Background to this update: Statutory Instrument 154/2010 - Road Traffic (Construction, Equipment and Use) Regulations, was declared invalid and void in November 2012. SI 412/1972 came back into force. SI 129/2015 replaces SI 154/2010 and came into operation on 14 December 2015. Secondly, Finance and Economic Development Minister Patrick Chinamasa announced in the National Budget for 2016 that Government will review traffic fines from 1 January, 2016. The Minister mentioned a number of offences which will attract fines of up to $100.00. The maximum deposit fine a police officer can legally impose is $20.00 per offence. (A level 3 fine). A fine higher than level 3 can only be imposed by a magistrate after a court appearance.In order for ZRP personnel to accept roadside payment of a $100.00 fine, currently level 4, the Criminal Procedure & Evidence Act has to be amended. Section 87 of SI 129/2015 lists the sections where on committing an offence, the motorist shall be liable, on conviction, to a fine not exceeding level 5. This section appeared in SI 154/2010 under section 88 - Offences and penalties, so although the exact listing of the various sections is different, there is nothing new in the addition of this section to SI 129/2015. Therefore, until the law regarding level fines has been constitutionally amended, the Schedule of Deposit Fines issued in August 2013, and level of fines remain in effect and are referred to in our Cubbyhole Notes. The attached update reflects the requirements of SI 129/2015 (Construction, Equipment and Use) Regulations, for the guidance of motorists.
